1. The Promoter
1.1 The Promoter is: Phantom Competitions Limited (Company Number 15362006) whose registered office is at 4 Humber Close, Northampton, NN5 7PA, United Kingdom.
1.2 Our correspondence address is: Phantom Competitions Limited, 4 Humber Close, Northampton, NN5 7PA, United Kingdom.
1.3 If you wish to contact us for any reason, please email info@phantomcompetitions.co.uk.
2. The competition
2.1 These Terms and Conditions apply to all competitions listed on the Promoter’s website at https://phantomcompetitions.co.uk/ (the “Website”).
2.2 An entry fee is payable each time you enter via our online entry method (the “Online Entry Route”). Alternatively, you may enter for free via the postal entry method outlined in paragraph 3.9 below (the “Free Postal Entry Route”).
2.3 Each person who enters either via the Online Entry Route or the Free Postal Entry Route is an “Entrant” for the purpose of these Terms and Conditions.
3. How to enter
3.1 Each Competition will run from when it is published on the Website to the closing date and time specified on the Website. These dates shall be referred to as the “Published Date” and “Closing Date” respectively. All times and dates referred to are the times and dates in London, England.
3.2 If it is absolutely necessary to do so due to circumstances beyond the reasonable control of the Promoter (and where not doing so would be unfair to those who have already entered), the Promoter reserves the right to change the Closing Date or correct an incorrectly displayed Published Date. Any updated details will be displayed on the Website as soon as reasonably practicable.
3.3 All Competition entries must be received by the Promoter no earlier than the Published Date and no later than the specified time on the Closing Date. Entries received outside these times may be disqualified without a refund. Entries received after the Closing Date will not be entered into the relevant Competition.
3.4 If an entry is received by the Free Postal Entry Route within 72 hours after the Closing Date, the Entrant will receive a credit equal to the cost of entry via the Online Entry Route to the draw. This credit may be used to enter an alternative Competition(s) of the Entrant’s choice on the Website using the Online Entry Route. For the avoidance of doubt, such late postal entries do not enter the closed Competition.
3.5 To enter a Competition using the Online Entry Route:
3.5.1 Draw-Based Competitions (Live Draws and Auto-Draws)
(1) go to the Website;
(2) select your desired number of entries;
(3) complete the checkout process and submit the online entry form; and
(4) complete payment to receive your order confirmation.
3.5.2 Instant Win Competitions
(1) go to the Website and view the Instant Win Competition;
(2) select your desired number of entries;
(3) complete the checkout process and submit the online entry form;
(4) complete payment to receive your ticket(s); and
(5) check your ticket(s) to see if you have won.
3.6 All entries must be submitted in the English language. Entries in languages other than English may be disqualified and no refund will be given.
3.7 The Promoter will send confirmation that your entry has been received. For Draw-Based Competitions and Instant Win Competitions, the Promoter will send your allocated ticket number(s) by email to the email address you used to register for your account.
3.8 The Promoter will not accept responsibility for Competition entries that are not successfully completed, are lost or are delayed regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
3.9 By purchasing entries, registering an account and submitting a Competition entry, you are entering into a contract with the Promoter and are agreeing to be bound by these Terms and Conditions.
3.10 You may enter the Competition for free using the Free Postal Entry Route by complying with the following conditions:
3.10.1 Send your entry on an unenclosed postcard by first or second class post to the Promoter at the following address:
Phantom Competitions Limited, 4 Humber Close, Northampton, NN5 7PA, United Kingdom.
3.10.2 Include with your entry the following information:
(i) your full name;
(ii) your address;
(iii) a contact telephone number and email address; and
(iv) your chosen Competition and your answer to any Competition Question (if applicable).
3.10.3 If you are entering an Instant Win Competition through the Free Postal Entry Route you will be required to register for an account via the Website prior to us receiving your postal entry. Following receipt of your valid postal entry we will apply site credit to your account equal to the cost of entry via the Online Entry Route. You must use this site credit to enter an Instant Win Competition via the Website and generate a ticket.
3.10.4 Incomplete or illegible entries will be disqualified.
3.10.5 You may make multiple free entries for any Competition (up to any limit placed on entries by the Promoter) but each free entry must be submitted and posted to the Promoter separately. Bulk entries will not be accepted as multiple entries and if a bulk entry is received, it will be counted as one single entry.
3.10.6 By entering the Competition, you are confirming that you are eligible to enter and accept these Terms and Conditions.
3.10.7 The Promoter will email each Entrant who has submitted a valid entry into a Draw-Based Competition via the Free Postal Entry Route to confirm their ticket number(s). If entering an Instant Win Competition, the Promoter will add site credit equal to the cost of entry via the Online Entry Route.
3.10.8 Entrants must have created an account on the Website for the free entry to be processed. All details on the postcard must correspond to the details on the account to receive the order confirmation and ticket number (or credit). Postal entries received without a registered account cannot be processed. Entrants must add an address to the related account for entries to be processed.
3.10.9 Only entries submitted by post will be accepted for the Free Postal Entry Route; hand delivered entries are not eligible.
4. Choosing a winner and allocation of outcomes
Draw-Based Competitions (Live Draws and Auto-Draws)
4.1 All Entrants who have entered a Draw-Based Competition in accordance with paragraph 3 above will be placed into a draw and the winner will be chosen using a verifiably random draw process (the “Winner”). The random draw will take place on the Closing Date (the “Draw Date”), unless the Competition page states otherwise.
4.2 All Entrants will have their names and ticket numbers collated for the purpose of the draw. For Live Draws, this may be displayed during the live draw. For Auto-Draws, the names and ticket numbers may be placed into a spreadsheet and a random selection process will be used, including use of the Mersenne Twister algorithm to determine the winner(s).
4.3 In the event of a draw being disrupted for any reason or having an inconclusive outcome, the Promoter may, acting reasonably, run the draw again either through the same random draw process or an alternative method to ensure a fair result.
Instant Win Competitions
4.4 All Entrants who have entered an Instant Win Competition in accordance with paragraph 3 above will be assigned a ticket (“Ticket Assignment”). Winning Instant Win tickets will be selected prior to the Published Date (“Winning Ticket Selection”). Ticket Assignment and Winning Ticket Selection will both be performed using a verifiably random process. Where an Instant Win Competition includes an end prize, end prize winner(s) will be chosen using a Draw-Based method.
4.5 For help with entries, please email us at info@phantomcompetitions.co.uk.
5. How the draws are conducted
5.1 Live Draws: The draw is ruled to be valid and complete and therefore results stand as they are, as long as the draw is conducted without interruption. If an unsold number is generated we will reload/refresh the selection and continue until a number is generated that has been sold.
5.2 Auto-Draws: The draw will be conducted using an automated random selection method, including the Mersenne Twister algorithm to select a random number/ticket.
6. Eligibility
6.1 The Competitions are open to anyone aged 18 years or over who is a resident in the UK, where it is lawful for the Entrant to enter the Competition and for the Promoter to promote the Competition and award the Prize to the Entrant, except:
(a) employees of the Promoter;
(b) employees of agents or suppliers of the Promoter who are professionally connected with the Competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
6.2 By entering any Competition, you confirm that you are eligible to do so and eligible to claim any Prize you may win. The Promoter may require you to provide proof that you are eligible to enter and/or claim a Prize (see paragraph 8.6). If you fail to provide proof within 21 days of a request, you may be disqualified and an alternative Winner may be selected.
6.3 The Promoter will not accept Competition entries that are:
(a) automatically generated by computer;
(b) submitted by agents, third parties or syndicated entries; or
(c) incomplete.
6.4 The Promoter reserves all rights to disqualify you if:
(a) the Promoter reasonably believes that you have acted in breach of these Terms and Conditions;
(b) the Promoter reasonably believes that you have acted in concert with other persons (including members of your household) or have submitted entries in another person’s name to circumvent these Terms;
(c) it is, or has become, illegal for the Promoter to promote the Competition to you and/or award the Prize to you;
(d) you are found to be abusing or tampering with the operation of the Competition or the Website, or entering using fraudulent means; or
(e) you are found to have posted an entry or comment to the Promoter’s social media that is, in the Promoter’s opinion, inappropriate, offensive or upsetting, or is contrary to applicable law.
6.5 Refunds will only be provided in exceptional circumstances and at the sole discretion of the Promoter. No refunds of entry fees will be given:
(a) if, following your entry, you find out you are not eligible to enter or claim the Prize; or
(b) if you are disqualified in accordance with these Terms.
6.6 Entrants can enter each Competition as many times as they wish until the maximum number of entries per user has been submitted and until the maximum number of entries for the Competition has been received.
6.7 Only one Account per household is allowed.
7. The prize
7.1 There may be one or more prizes available for each Competition, which are described on the relevant Competition page of the Website (the “Prize”). Details are correct to the best of the Promoter’s knowledge at the time the Competition is published.
7.2 Non-cash prizes are subject to availability. The Promoter reserves the right to substitute the Prize with one of equal or greater value. If any details change, the Promoter will aim to update the Website as soon as reasonably practicable.
7.3 The Promoter makes no representations or warranties about the Prize, its value, its condition, or any information provided on the Website, and does not guarantee that information is complete or fully up to date at all times.
7.4 If the Prize is a vehicle:
(a) the Promoter will, unless otherwise stated, ensure it comes with a valid MOT (if required);
(b) no insurance is included and the Winner must ensure adequate insurance prior to driving;
(c) the Promoter has no responsibility for the Prize once delivered/collected; the Winner is solely responsible for legal compliance and safe operation;
(d) no vehicle/road tax is included;
(e) the Winner is responsible for appropriate safety equipment/clothing where relevant.
7.5 Other non-cash prizes may be subject to additional conditions stated on the relevant Competition page.
7.6 The Prize may be supplied by a third-party supplier. Details (if any) will be provided on the Website.
7.7 The Promoter reserves the right to substitute the Prize for a cash alternative (“Cash Prize”) where:
(a) the Prize becomes unavailable; or
(b) circumstances beyond the Promoter’s reasonable control make substitution necessary.
7.8 The Prize is not negotiable or transferable.
7.9 All costs and expenses not included with the Prize are the responsibility of the Winner.
8. Winners
8.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.
8.2 The Winner’s full name may be announced during a Live Draw.
8.3 The Promoter will contact the winner of a Draw-Based Competition as soon as reasonably practicable after the Draw Date, using the telephone number or email address provided with the Competition entry.
8.4 The winner of a Prize in an Instant Win Competition will receive an email and must follow the instructions contained in that email to claim the Prize. Prizes of site credit will be applied to an Entrant’s account automatically.
8.5 The Promoter will make all reasonable efforts to contact the Winner. If the Winner cannot be contacted or has not claimed the Prize within 21 days of the Draw Date, the Promoter reserves the right to offer the Prize to another Entrant (“Alternate Winner”) selected at random using the same method from the remaining valid entries. This process shall continue until a Winner accepts the Prize.
8.6 If a selected Winner has won a prize above a value threshold set by the Promoter, the Winner must provide valid proof of identity and address which matches the name and address used to register. If the Winner does not provide such proof within 21 days of accepting the Prize, the Promoter may investigate and, if the Promoter cannot verify the Winner within 3 months of the draw, the Promoter reserves the right to offer the Prize to an Alternate Winner.
8.7 The Promoter must either publish or make available information that indicates a valid award took place. To comply, the Promoter will publish the full name of major prize winners on the Website unless you object in accordance with paragraph 8.8.
8.8 If you object to any or all of your name and winning entry being published, please contact the Promoter at info@phantomcompetitions.co.uk prior to the Closing Date. In such circumstances, the Promoter must still provide this information to the Advertising Standards Authority on request.
9. Claiming the prize
9.1 You must claim the Prize personally. The Prize may not be claimed by a third party on your behalf. Delivery/collection details will be provided on the Website or made available on request.
9.2 If your personal details change, you should notify the Promoter as soon as reasonably possible by emailing info@phantomcompetitions.co.uk and including the Competition details, old details and new details. If your details change within 10 days of the Closing Date, the Promoter may use your old details if it needs to try to contact you.
9.3 Any Cash Prize will be transferred directly to the Winner’s nominated bank account. The Winner must provide evidence that they are the sole or joint beneficiary of the bank account. Failure to do so within 21 days of accepting the Prize may result in disqualification and forfeiture, and the Promoter reserves the right to offer the Prize to the next eligible Entrant.
9.4 The Promoter does not accept any responsibility and is not liable to pay compensation if you are unable to or do not take up the Prize.
9.5 If the Prize is a vehicle and the Winner has completed all eligibility checks, the Prize will be transferred to the Winner by the Promoter using the V5 process. This may be completed after handover.
10. Limitation of liability
10.1 If the Promoter fails to comply with these Terms and Conditions, the Promoter is responsible for loss or damage you suffer that is a foreseeable result of the Promoter’s breach or negligence. The Promoter is not responsible for any loss or damage that is not foreseeable.
10.2 Loss or damage is foreseeable if it was an obvious consequence of the breach or if it was contemplated by you and the Promoter at the time you entered the Competition.
11. Data protection and publicity
11.1 By entering a Competition, you agree that personal information provided by you may be held and used by the Promoter (and its service providers) for administering and managing Competitions, awarding prizes, and for other purposes as set out in the Promoter’s Privacy Policy available on the Website.
11.2 If you submit content it may be used for reasonable publicity by the Promoter. If you do not wish to participate in publicity, you must notify the Promoter. This will not affect your chances of winning.
11.3 If you do not agree to participate in publicity, the Promoter may still provide winner information to the Advertising Standards Authority where required to demonstrate that a Competition has been properly administered and prizes awarded.
11.4 Under data protection laws you may request that the Promoter stops contacting you and removes your details. If you make such a request while a Competition is ongoing, you will be treated as withdrawing from the Competition because the Promoter cannot contact you if you win. No refund will be due in such circumstances.
12. General
12.1 The Promoter reserves the right to amend these Terms and Conditions from time to time. The latest version will be available on the Website.
12.2 If there is reason to believe there has been a breach of these Terms, the Promoter may, at its discretion, exclude you from participating in the Competition and/or future competitions.
12.3 The Promoter reserves the right to hold void, suspend, cancel, or amend a Competition at any time where circumstances beyond its control make this unavoidable. If a Competition is cancelled, the Promoter will return entry fees to Entrants (by refund to the original payment method where possible). Where entry fees are returned, the Promoter shall have no further liability.
12.4 The Competitions are in no way sponsored, endorsed, administered by or associated with Meta, Apple or Google. By entering, Entrants agree that neither Meta, Apple nor Google have any liability and are not responsible for administration or promotion of the Competitions.
12.5 These Terms and Conditions shall be governed by English law.
12.6 The courts of England and Wales shall have jurisdiction over any claims arising from these Terms and Conditions.
12.7 You should print or save a copy of these Terms and Conditions and keep them for your records.
